Terms of Service
1. The service
TUSK is a hosted sales CRM for web-design studios, available at tuskcrm.com under paid subscription plans. By creating an account you accept these terms. If you use TUSK for an organization, you represent you can bind that organization.
2. Accounts and workspaces
You must provide accurate account information and keep your credentials secure. Workspace owners control membership and are responsible for the people they invite. You are responsible for activity under your account.
3. Subscriptions and billing
- Plans: Solo and Team, billed monthly in advance via Stripe at the prices shown at purchase. New accounts start on a free trial with capped workspace capacity (currently 20 leads).
- Subscriptions renew automatically until canceled. Cancellation takes effect at the end of the current billing period. Manage billing through the customer portal.
- Refunds: fees are non-refundable except where required by law.
- Failure of payment may result in restricted access after 14 days. Taxes are your responsibility where applicable.
4. Your content
You retain all rights to the content you store in TUSK (leads, clients, documents, invoices). You grant us the limited license needed to host, process, back up, and display it to you and your workspace members in order to provide the service. You are responsible for having a lawful basis for the personal data you store about your own leads and clients; between you and us, you are the controller of that data and we process it on your instructions.
5. Acceptable use
You may not: abuse, probe, or disrupt the service or other tenants; attempt to bypass tenant isolation, rate limits, or authentication; store unlawful content; use the service to send spam, including email that violates applicable anti-spam law; resell the service without agreement; or upload malicious code. We may suspend accounts that endanger the service or other customers, with notice where practicable.
6. Availability and support
The service is provided with commercially reasonable efforts, without an uptime guarantee. Support is provided via jord9211@gmail.com with no guaranteed response time.
7. Data export, termination, and deletion
You can export workspace data at any time. On account deletion, solely owned workspaces and their stored files are deleted and sessions revoked, as described in the Privacy Notice (including backup-rotation timing). We may terminate accounts for material breach of these terms; where practicable we will provide notice and an export window of 30 days.
8. Disclaimers and liability
The service is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, our aggregate liability for all claims in any 12-month period is limited to the fees you paid for the service in that period; neither party is liable for indirect, incidental, or consequential damages. Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Changes to the service and terms
We may modify the service and these terms; material changes will be notified to account owners at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
10. Governing law
These terms are governed by the laws of the operator's home jurisdiction in the United States. A specific governing law and venue will be fixed in the first formally reviewed revision of these terms and posted here.
